According to the details, the Islamabad High Court has issued important instructions on the request for suspension of sentence in the Idda Nikah case. Apart from this, the Islamabad High Court ordered the Sessions Court to pronounce judgment on the central appeals in the illegal marriage case within a month.
It is being told that a hearing was held in the Islamabad High Court regarding the marriage case in Eid, Islamabad High Court Justice Mian Gul Hasan Aurangzeb conducted the hearing, PTI founder Imran Khan's lawyer Salman Akram Raja and Bushra Bibi's lawyer Salman Safdar. Appearing in the court, Salman Akram Raja said that Sessions Judge Shahrukh Arjumand had fixed the date of judgment on the appeals against the sentence, on May 29, the Sessions Judge sent a report to the Chief Justice instead of pronouncing the judgment, even though the arguments were complete. After that, only the verdict was left, on May 23, the session judge said that he would pronounce the verdict on May 29, but on May 29, the complainant came to the court and made noise and distrusted the court, Justice Mian Gul Hasan Aurangzeb inquired. "Whether the arguments were completed on 23rd?", lawyer Salman Akram Raja said that "after the arguments were completed, the court reserved its decision". But expressed no confidence in the judge?', the lawyer said, 'On May 29, he did not file a written application but filed a motion of no confidence before that, which was rejected. Rejected'.
The court asked that 'was that order of the session court challenged?', lawyer Salman Akram Raja said that 'no that order was not challenged', Justice Hasan Aurangzeb inquired that 'you say the session judge back. Send the matter or let the High Court itself hear it?', Salman Akram Raja said that 'the case cannot be sent from the Sessions Judge to his subordinate Additional Sessions Judge', Justice Mian Gul Hasan Aurangzeb inquired that 'Chief Justice Islamabad High Court What reason did he write in the order?', Salman Akram Raja said that 'Chief Justice Aamir Farooq's order was an administrative order and we do not have a copy of it, Chief Justice Aamir Farooq decided without giving us notice.
Lawyer Salman Akram Raja took the stand that 'the administrator order of the High Court cannot cancel a judicial order or prevent it from relief', Justice Hasan Aurangzeb remarked that 'if a judge has sent back the case himself, then what can he do? Would it be appropriate to send the case back? Would it not be appropriate that we send this case to another judge with narration?', Imran Khan's lawyer said that 'Judge Shahrukh Arjumand wanted to decide the case, can any other petitioner do that? Accuse the judge and transfer the case?
Justice Mian Gul Hasan Aurangzeb remarked that 'Sharkh Arjamand is one of the best judicial officers, how long did the trial of the Nikah case in Idt be completed?', lawyer Salman Akram Raja replied that 'in three days', Justice Mian Gul Hasan Aurangzeb said 'No, no, I am asking how long did the trial take?', Salman Akram Raja replied that 'I am talking about the trial, the trial was completed in three days after twelve hours. ', Justice Mian Gul Hasan Aurangzeb asked 'When was the charge framed in the case?'.
Imran Khan's lawyer said that the charge was framed on January 16, 2024, but the trial was completed in three days. The judge was given a date that you have to decide on this date. And we also have reservations about it, if we go tomorrow and make the same objections to this judge, then what will happen? If a Sessions Judge is ineligible and then the Additional Sessions Judge became eligible?', the court later issued a notice to Khawar Manika on the appeal of founder PTI Imran Khan and sought her reply on June 13.
